Generation IV

Robert de Isham

1330–1388

Life

Robert de Isham of Pytchley, Northamptonshire, was a fourteenth-century landowner, legal attorney, and creditor who represented the crucial third-generation link in the medieval Isham pedigree.? Born around 1330, he was the son of Henry de Isham and his wife, whose name appears in various family records as Agnes or Margery.1,2 Robert's place in the lineage is explicitly confirmed in late fifteenth-century Court of Common Pleas pleadings, which trace the family through a succession of three generations of Roberts descending from Henry Isham.2 An early Common Pleas appearance around 1340 summoned Henry and Margery Isham alongside Robert their son and his sister Margery in a dispute brought by John le Clerk over land and meadow in Pytchley.1 While older genealogical compilations mistakenly utilized an entry from the 1329–1330 Northamptonshire eyre to date his adulthood, modern archival analysis confirms that those earlier eyre proceedings pertained to an elder namesake, placing this Robert's secure independent adult activities from the early 1360s onward.?

Robert established himself prominently in the central royal courts during the later reign of King Edward III, engaging in extensive creditor litigation and professional legal practice.? Between 1361 and 1364, he appeared frequently in the Court of Common Pleas alongside local associates Richard de Caldecote of Stoke Doyle and John Norman of Desborough, prosecuting substantial debts across Northamptonshire, including claims of forty marks against Thomas Fox3, twenty marks against Thomas Rex4, and forty marks against William Maydewell junior and others.? In 1363, he appeared in the Court of King's Bench in matters involving John de Whatton, Richard Goys, and William Stathern5, and in that same year acted as the formal legal attorney in King's Bench for William de Pyghtesley, chaplain, in a trespass and assault action brought by the parson of Lobenham.6

By the mid-1370s, Robert had married Julian, who is firmly documented as his wife in contemporary property settlements.7,8 Between 1376 and 1377, the couple was central to a series of significant conveyances involving John Parker of Pytchley and John Parker of Olney.7,8 A fine levied in 1376–1377 confirmed that Robert and Julian held a life estate in a messuage, two virgates of arable land, six acres of meadow, and associated rents in Pytchley, with the reversionary interest assigned to John Parker of Olney.7,9 In December 1377, these arrangements were formalized and expanded in Common Pleas enrollments, whereby John Parker of Pytchley granted Robert and Julian the reversion of a toft and two acres following the death of Henry Parker of Moulton, while John Parker of Olney quitclaimed all right in substantial Pytchley tenements to Robert, Julian, and Robert's heirs forever.8,10 In turn, Robert enrolled his own grant of Moulton rents to John Parker of Olney.8,10 While Julian is securely established as Robert's wife in these transactions, contemporary records leave it unproven whether she was the biological mother of Robert's son and heir, Robert Isham, who was born around 1370.?

Throughout the reign of King Richard II, Robert remained vigorous in managing and protecting his estate.? In 1379, he brought an assize of novel disseisin in King's Bench against William and Matilda de Garton and Henry Parker of Moulton over an acre and a half of land in Pytchley.11 In May 1383, he joined William Couele of Rothwell the elder as a querent in a fine settling messuages, land, and meadow in Harlestone.12 In 1386 and 1387, he prosecuted two significant disputes in King's Bench arising from conflicts on his Pytchley estate: he sued Henry Pickering for an armed assault upon his servant Roger Prentys, claiming twenty pounds in damages for the resulting loss of service13, and he initiated proceedings under the Ordinance of Labourers against his former carter and ploughman, Robert Drury, who had broken his agreement and abandoned his post prematurely.14 Robert lived at Pytchley through at least 1388, and he may have been the plaintiff in Common Pleas actions in 1391 and 1392 concerning pasture trespass and a writ of cui in vita in Pytchley, though those entries fall chronologically on the threshold between his own final years and the early career of his son.15,16 Robert de Isham died after 1388, leaving to his son Robert the consolidated landed patrimony that formed the foundation for the family's fifteenth-century rise.?
